Overview & Responsibilities

BACKGROUND

Kenya has implemented various national and international legal instruments to address corruption and promote good governance. The Constitution of Kenya has entrenched values and principles of leadership and integrity. Adherence to these values and principles is binding to all state organs, state officers, public officers, and all persons whenever any of them applies or interprets the Constitution, enacts, applies, or interprets any law, or makes or interprets public policy decisions. Various statutes require state organs to put in place mechanisms for combating corruption.

In this regard, IDLO in partnership with the Judicial Service Commission (JSC) intends to engage an expert to develop anti-corruption policies and strategies for JSC.

 

About Judicial Service Commission (JSC)
The Judicial Service Commission (JSC) is an independent body established under Article 171 of the Constitution of Kenya. The JSC is mandated to promote and facilitate the independence and accountability of the Judiciary and the efficient, effective, and transparent administration of justice. The JSC’s functions include recommending persons for appointment as Judges, reviewing conditions of service for Judges and Judicial Officers other than excluding remuneration, and the staff of the Judiciary, receiving and considering petitions for removal from office of the judges under Article of the Constitution, appointing, receiving and investigating complaints, against judicial officers and staff, preparing and implementing continuing education and training programmes for Judges and Judicial Officers, and advising the National Government on improving the efficiency of justice administration.

 

THE ASSIGNMENT

 

The policies will be used by the JSC to promote and strengthen measures to prevent and combat corruption more efficiently and effectively.

The consultant’s duties and responsibilities will include:

  1. Conducting a comprehensive analysis of the legal, policy, and administrative structures governing transparency and accountability within the JSC.
  2. Conduct stakeholder mapping and engage all relevant stakeholders interacting with the JSC to identify challenges and proposals on how to enhance accountability and transparency.
  3. Submit a draft Anti-corruption Policy and Strategy for approval by the JSC and IDLO.
  4. Facilitate an inclusive and interactive validation process for review of the Draft during stakeholders’ meetings.
  5. Submit the final Anti-Corruption Policy and Strategy for the JSC and IDLO in ready-to-print format.

DELIVERABLES

The Consultant will deliver the following:

  1. Develop an inception report, including an annotated outline indicating an understanding of the assignment, a proposed work plan for the execution of the assignment, methodology, and timelines by the 3rd day upon signing the contract.
  2. Submit draft Anti-corruption policies and strategies for approval by the JSC and IDLO.
  3. Facilitate an inclusive and interactive validation process for review of the draft during stakeholders’ meetings.
  4. Submit the final Anti-Corruption Policy and Strategies for the JSC and IDLO in a ready-to-print format.
Job Requirements

EDUCATION

  • Bachelor’s Degree in Law (LLB), public policy, or any other relevant qualification from a university recognized in Kenya

TECHNICAL COMPETENCIES

  • Demonstrated at least seven (8) years of experience and competencies in public policy development, including experience in developing guidelines or monitoring tools.
  • Experience in developing national anti-corruption policies, strategies, standard operating procedures and public campaigns.
  • Excellent knowledge and understanding of theories, concepts and approaches relevant to corruption, and economic crimes-related issues.
  • Experience working within or providing technical advisory services to anti-corruption bodies.
  • Excellent analytical, writing, and editing skills.
  • Excellent work ethic founded on integrity, impartiality, and confidentiality principles.
